Definitions

“Team” is an refers to the collective body of agents within the team organization.
“Team Leader” is the primary leader of the team organization.
“the Brokerage” or “the Company” refers to Epique Realty, LLC

Addendum to Contract
*
I/We understand that this is an addendum to the existing agreement already completed and agreed to as an individual agent. All statements, agreements, and terms from the Individual Contractor Agreement (ICA) are still in effect unless specifically supplanted or modified by this agreement. No other changes will be made to the ICA that do not exist in this agreement.
Application Request

I/We understand that this is a request. I/We understand that our request may be denied. I/We understand that we do not have a right to a team, and that the allowance of a team/teams is at the sole discretion of the company. Teams may be dissolved or restructured for many reasons, including but not limited to: missed payments, failure to reach sales metrics, instability in leadership, violation of ICA agreement by agents, and others.
SINGLE ENTITY -- Commissions, Payouts, Benefits, etc.

I/We understand, agree to, and accept that as a Team, we will be treated as a single entity in regards to payouts for commission, profit sharing, awards earned (stock, crypto, etc). Many benefits will be given as a shared benefit (including but not limited to Technology logins and access, etc.). Some benefits will remain individual based.

FEES
These terms may change at any time. You will be notified of any changes that may occur that alter this schedule.
Domestic Team Signup Fee: $299 Total
*
Covers costs for setup of all accounts, tech setup, business cards, marketing materials, onboarding concierge service, transaction coordinator setup, lead generation setup, social media setup, and more. Second person joining may be prorated if first team member already paid dues. Signup fee may be waived if both have already paid to join. There are no refunds, partial refunds, or credits for individuals who have joined then decided to form a team afterwards.
Domestic Team Cloud Brokerage Fee: $199 per month total

Cloud Brokerage Fee: $199 per month
Covers costs for all technology (websites, agent apps, CRM, transaction software, social media maintenance, etc.), leads & lead generation services, marketing concierge, and all extra benefits.
Transaction Fee: 0.1% of Gross Price per Transaction

Transaction Fee: 0.1% of gross price per transaction.
Covers costs for Transaction Coordinators/Concierge, Marketing Allowance, Broker Review, and Risk Management (E&O) Transaction Coverage. This shall be deducted from all closings. Transaction fees do not apply towards commission caps. In the event of multiple Epique contractors working the same side of a transaction, the transaction fee will be split among the contractors based on the commission structure for each deal.

This is included at no additional charge.
Processing Fee: $5.95
*
A processing fee not to exceed $5.95 may apply to transactions billed to credt cards.
All fees are non-refundable. Sales tax laws and regulations for each state determine if a fee is subject to sales tax. If applicable, sales tax is applied as a separate line item on Contractor’s statement.
Domestic Team Annual Fee: $299

An annual fee of $299 will be due on the anniversary of your join date.
Non-Refundable
*
All fees are non-refundable. Sales tax laws and regulations for each state determine if a fee is subject to sales tax. If applicable, sales tax is applied as a separate line item on Contractor’s statement.
Both a primary and a secondary/backup electronic funds transfer funding source, one of which must be an Automatic Clearing House (ACH) source, for payment of any and all recurring and non-recurring fees and amounts due from Contractor under this ICA must be on file and kept current. Unused portions of any fees previously paid will not be credited/prorated. Unpaid fees, charges, repayments, and any other amounts Contractor owes to Company can and will be deducted directly from any and all of Contractor’s pending and future earnings that would otherwise be payable to Contractor by Epique Realty, LLC.

COMMISSION STRUCTURE
Commission & Transactions

Team shall be entitled to a commission on sales, rental/lease transactions, broker price opinions (“BPOs”) and referrals (collectively “Transactions”) as follows: income retained by the Company after referrals and concessions, but prior to commission split (“Gross Commission Income”), shall be split at an agreed upon rate to Contractor (“Contractor Dollar Amount”) and to Company (“Company Dollar”) on all Transactions closed by the Contractor.
Commission Splits -- 85/15 Split

Company will receive 15% of Gross Commission and team will receive 85% of Gross Commission. Standard & Power Teams may have their own split with their agents that exceed 15%. Should any transactions be subject to any state or local taxes, the split will be calculated after the tax is deducted.

COMMISSION CAPS
Declining Caps

Declining Caps do not apply to Domestic Teams, or to Team agents. Team Leaders of Standard or Power Teams do have access to declining caps. Domestic Teams share a $15K Cap. Standard and Power Team agents have a $10K Cap.
